Refund and Cancellation Policy

At Immigration & Visa Maestro, we strive to offer the highest standards of immigration and visa consultancy services. As part of our transparent service framework, this Refund and Cancellation Policy outlines all scenarios in which a refund or cancellation may be applicable, the process involved, and our commitment to fairness and integrity.

We urge all clients to read this document carefully before signing any service agreement or proceeding with any transaction. Upon engaging our services, you confirm that you have understood and agreed to all terms and conditions mentioned herein.

1. Purpose of This Policy

This policy is intended to:

  • Define the circumstances under which a client may request a refund or cancellation.
  • Establish procedures for submitting refund/cancellation requests.
  • Outline the conditions where refunds are strictly not applicable.
  • Inform clients of timelines and limitations applicable to the process.

2. Scope of This Policy

This policy is applicable to all clients who have:

  • Paid a security deposit or service fee to Immigration & Visa Maestro.
  • Signed or digitally accepted our Service Agreement / Terms of Engagement.
  • Engaged our services for immigration, visa consultancy, job placement assistance, or related services.

3. Refund Eligibility – Security Deposit

A refund of the security deposit is permitted only under specific circumstances as outlined below:

3.1. Early Withdrawal (Pre-Interview Stage)

Clients are eligible for a full refund of the security deposit if the following conditions are met:

  • The refund request is submitted within 7 working days from the date of payment.
  • The client has submitted all required documentation within that time frame.
  • No interview, pre-interview discussion, consultation, or orientation session has been scheduled or conducted.
  • There is a value to the time an immigration consultant spends on his client, so even if you withdraw after a consultation and a decision is reached, a consultation charge will be levied. This may vary depending on the situation.
  • Immigration consultant will charge a minimum amount of ₹1500 INR plus taxes.

⛔  Once an interview (including mock or pre-interview session) has been scheduled, the client forfeits the right to a refund under this clause.

3.2. Interview Rejection

Clients are eligible for a refund if:

  • The candidate is rejected during the official interview process with the employer.
  • The candidate had submitted all required documents and was financially cleared before the interview.

Interview eligibility begins only after the client’s documents are fully verified and payments are complete.

3.3. Special Humanitarian Circumstances (Subject to Management Approval)

In rare and grave situations, partial or full refunds may be considered at the sole discretion of Immigration & Visa Maestro:

Eligible conditions include:

  • Critical medical emergency or long-term disability of the candidate or their immediate family (spouse, child, parent).
  • Death of a first-degree family member of the candidate or financial sponsor.

Mandatory Requirements:

  • Valid supporting documentation (e.g., original medical reports, death certificates).
  • Proof of financial reallocation or hardship.

⚠  This clause does not constitute a right to refund and is purely a goodwill-based gesture at the discretion of the company’s senior management.

4. Refund Processing & Timelines

  • Approved refunds will be processed only on the 15th or 30th of the following month after final approval.
  • Refunds are disbursed within 45-60 working days from the date of approval.
  • Refunds will be made through the original payment method unless explicitly requested otherwise.
  • Refunds are calculated only on the base amount All applicable GST (18%), bank charges, and other government or third-party fees will be deducted.
  • No interest shall be paid on refund amounts under any circumstances.

5. Non-Refundable Scenarios

No refund will be provided under any of the following circumstances:

5.1. Incomplete Documentation

  • If the candidate fails to submit all mandatory documents within 5 working days of paying the security deposit.
  • If documents are not emailed in the required format to the official email IDs.

Such delays result in automatic cancellation of candidature.

5.2. No Show or Non-Participation

  • If the candidate fails to appear for:
    • Interview or pre-interview preparation sessions.
    • Orientation, training, or internal assessment rounds.
  • If the candidate is unreachable or unresponsive despite reminders.

5.3. Post-Offer Withdrawal

  • The candidate receives a formal offer letter from the employer but:
    • Chooses to back out voluntarily.
    • Fails to fulfill the obligations stated in the offer.
    • Causes the offer to be withdrawn due to non-compliance.
  • No refund will be processed if the candidate backs out after the visa has been issued.
  • Every kind of legal action will be taken if there is some pending amount from client side.

5.4. Misconduct, Misrepresentation, or Fraud

  • If any document submitted is:
    • Found to be forged, falsified, or manipulated.
    • Inconsistent with prior declarations.
  • If the candidate has a history of visa violations or legal infractions.
  • If the candidate provides false or misleading information during the application process.

5.5. Third-Party or Government Rejections

Refunds will NOT be issued in the following circumstances:

  • Rejection of visa or application by the embassy, high commission, or any immigration authority.
  • Failure to obtain a passing score in language proficiency tests (IELTS, PTE, etc.).
  • Failure in medical examination.
  • Inability to provide a clean Police Clearance Certificate (PCC).
  • There will be no refund of any kind due to delay/rejection in visa processing due to submission of any fraudulent or fabricated documents by client side.
  • Delay, hold, or rejection by government departments or external third parties over which the company has no control.

6. Refund and Cancellation Request Procedure

Clients must adhere to the following steps for requesting a refund or cancellation:

Step 1: Written Request

Send a written request to the official emails:

Step 2: Required Information

The email must contain:

  • Full Name (as per service agreement)
  • Registered Mobile Number
  • Date and amount of payment
  • Mode of payment and transaction reference
  • Reason for requesting refund/cancellation
  • Bank account details (if different from original payment method)

Step 3: Attachments

Attach all relevant supporting documents:

  • Payment receipts
  • Offer letter (if applicable)
  • Death certificate, medical certificate, or other related documents (if invoking Clause 3.3)

⛔  Incomplete or undocumented requests will not be processed.

7. Additional Terms and Disclaimers

7.1. Limitation of Liability

Immigration & Visa Maestro’s maximum liability is limited to the amount paid as a consultancy or service fee, excluding third-party charges or government fees.

7.2. No Guarantee Clause

The company does not guarantee:

  • Job placement abroad
  • Visa approval
  • Timelines or specific processing durations

All decisions rest solely with respective government departments and consular authorities.

7.3. Non-Transferability

  • Refunds, if applicable, are non-transferable to any third party, family member, or alternative applicant.
  • Service credits or paid fees cannot be adjusted against other services or applicants.

7.4. Modifications

The company reserves the right to modify or update this policy at any time. Clients will be bound by the version active at the time of request or dispute.

8. Governing Law and Jurisdiction

This policy shall be governed by the laws applicable in India, and any disputes arising under this policy shall be subject to the jurisdiction of courts located in Rohtak, Haryana.
